Welcome to CaliPay.in ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our web application and mobile applications (iOS and Android) designed for Residents Welfare Associations (RWAs) and managing committees of residential buildings or complexes in India.
Important: Our services are designed for use in India only. We do not support or encourage anyone outside India to use this application.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.
2. Acceptance of Terms
By creating an account or using our Service, you acknowledge that you:
- Are at least 18 years old
- Are a resident or authorized representative of an RWA in India
- Have the legal capacity to enter into these Terms
- Will comply with all applicable laws and regulations
- Will provide accurate and complete information
3. Service Description
CaliPay.in provides a digital platform for RWAs to manage:
- Member registration and verification
- Payment collection and processing
- Invoice generation and management
- Expense tracking and reporting
- Community communication and announcements
- Financial ledger and accounting
- Late fee policy management
4. User Accounts and Responsibilities
4.1 Account Creation
- You must provide accurate, current, and complete information
- You are responsible for maintaining account confidentiality
- You must notify us immediately of any unauthorized access
- One person may not maintain multiple accounts
4.2 User Conduct
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Upload malicious code or viruses
- Attempt to gain unauthorized access to our systems
- Share false or misleading information
- Use the Service outside of India
5. Payment Terms
5.1 Payment Processing
- All payments are processed through certified third-party payment processors
- We do not store complete payment card information
- Payment failures may result in service restrictions
- Refunds are subject to RWA policies and applicable laws
5.2 Service Fees
- Service fees will be clearly communicated before any charges
- Fees may vary based on transaction volume and services used
- Price changes will be notified in advance
6. Intellectual Property
The Service and its original content, features, and functionality are owned by CaliPay.in and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written consent.
7. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Service, you agree to our Privacy Policy.
We comply with Indian data protection laws including the Information Technology Act 2000, SPDI Rules 2011, and the Digital Personal Data Protection Act 2023.
8. Service Availability
- We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We reserve the right to modify or discontinue features with notice
- Emergency maintenance may occur without prior notice
9. Limitation of Liability
To the maximum extent permitted by law, CaliPay.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Important: Our total liability for any claims arising from these Terms or the Service shall not exceed the amount paid by you to us in the 12 months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless CaliPay.in and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.
11. Termination
11.1 Termination by You
- You may terminate your account at any time through account settings
- Termination does not relieve you of any outstanding payment obligations
- Some data may be retained as required by law
11.2 Termination by Us
We may terminate or suspend your account immediately if you:
- Violate these Terms
- Provide false or misleading information
- Engage in fraudulent or illegal activities
- Fail to pay outstanding fees
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in [City], India.

15. Mobile Application Terms
Additional terms apply to our mobile applications:
- Apps are available only on official app stores (Apple App Store, Google Play)
- App store terms and conditions also apply
- We may require app updates for security or functionality
- Device permissions are used only for stated purposes
These Terms of Service are effective as of June 3, 2025 and apply to all users of CaliPay.in services in India.
